WASHINGTON- FBI General Counsel James Baker has confirmed what many have been reporting as unconfirmed for months, that Democratic Presidential Candidate, Hillary Clinton, is, in fact, being investigated by the FBI for using a private email server to conduct State Department business.
Clinton used a private email server when she was the Secretary of State. At issue is whether the email server contained classified information. If she is found to have used a non-secured private email server for transmitting classified information, she could face several felony chrges.
The revelation came in the form of a letter Baker wrote the acting legal advisor of the State Department, Mary Mcleod. In the letter, Baker referred to the investigation as “ongoing.”
The declaration that there was an ongoing investigation was given to explain why the FBI was unable to provide information the State Department was requesting. The letter came to light after a Freedom of Information Act (FOIA) was filed by Judicial Watch.
The Justice Department provided the letter to Judicial Watch, which then made it available to the public today, February 9th.
The letter also contained another key piece of information. Baker stated that while he had declined to confirm or deny that an investigation was taking place back in September, he is now free to do so as the FBI has “acknowledged generally” the investigation is actually taking place.
RNC Chair Reince Priebus issued a statement about the investigation, saying, “The FBI’s announcement confirms the investigation into Hillary Clinton’s secret email server is far from the routine ‘security review’ she has claimed. Clinton’s conduct was a severe error in judgment that grossly endangered our national security and put highly classified information at risk.”
Here is the text of the letter Baker sent on February 2nd, 2016.
Dear Ms Mcleod:
I am writing to update my September 21, 2015, response to your letter dated September 2, 2015, regarding Judicial Watch v Department of State, 13-cv-1363 (D.D.C.), and your request for the information pursuant to the Court’s Order of August 20, 2015. At that time, I informed you that the FBI could neither confirm nor deny the existence of any on-going investigation. Since that time, in public statements and testimony, the Bureau has acknowledged generally that it is working on matters related to former Secretary Clinton’s use of a private em-email server. The FBI has not, however, publicly acknowledged the specific focus, scope, or potential targets of any such proceedings. Thus, while the FBI’s response to you has changed to some degreee due to these intervening events, we remain unable provide the requested information without adversely affecting on-going law enforcement efforts.
